I'd say that:
1) don't depend on MP3 for your application's sounds. There are free formats
that are guaranteed to be present;
or
2) depend on MP3 and gracefully degrade the feature if the Multimedia layer
can't play those files.
If you're confident that no device will ship without MP3 support, then almost
no one will see the degraded functionality.
