Those are the advertisements that Gmail displays under the promotions
category tab when you're using the tabbed inbox format.  They look like
emails because they're displayed in the same list as whatever emails you
have currently in your promotions category.  I usually see two or three of
those whenever I have emails waiting for me there.

They're not emails so you can't mark them as spam.  There should be a
dismiss button displayed if you view them.

You can always just select not to display the promotions category tab.  If
you do that, your promotional emails will be displayed in your regular
primary tab.
