Hah... You know I dunno what I would be worried about actually loosing in court to the G729 Consortium et al, but what I would be worried about is the money they have to litigate you into oblivion... Yes the G729 and AMR patents are valid in most of the world as they are not software patents... Not to mention when running versions of the codecs on generic computer hardware that are not 'channel limited' they consider that to be worth 10,000 (yes 10 thousand) channels...
