No matter how many times you (or others) keep repeating this, it

patent issue proofs one and only one thing: You (and others who have  
argued this way) are not a lawyer, never went to law school, never  
took a bar exam, never received professional advice from a qualified  
lawyer on this matter.

This means you are neither qualified to interpret the law yourself,  
nor are you authorised to give legal advice and you are not passing  
on the opinion of a qualified legal professional either.

Now, I am not a lawyer, but I happen to work for a company which  
regularly pays lawyers for clarification on such matters when they  
arise and from the written professional legal advice my company has  
received in the past on this particular issue and other similar  
issues I can say that you are wrong.

To anybody who still doesn't want to let go of their desperate but-I- 
want-it-to-be-this-way-because-it-suits-me attitude I recommend that  
they pay a qualified patent attorney for a written legal opinion on  
the matter and then see for themselves. Anybody who has not received  
professional advice from a legal professional qualified to give such  
advice and who is therefore not in a position to pass on the opinion  
of a qualified professional here should keep their unqualified  
opinions to themselves. It is potentially harmful and at the very  
least irresponsible to spread unqualified legal opinions in public.

There is only Spanish on that site, but more importantly this is not  
an authoritative source of information on legal matters. The site is  
run by IT folks (it says so) and no lawyers are involved. How can we  
tell no lawyers are involved? Because lawyers are by law obliged to  
tell when they are giving a legal opinion and they are also obliged  
to say when their opinion can be considered legal advice or not.  
There are no such references.

Once again, if you want to get authoritative advice on this matter  
PAY A LAWYER. Anyone else is irrelevant.
