Wow Fabio. No - a kernel bug is a kernel bug. it may be related to the way Ubantu works with hardware, but it is STILL a defect in the kernel. I have reported the issue to you. If you choose not to do anything about it then that's fine by me, as I will not be using this product - it's broken.
