It actually is, in this case..  If you hold a credit card or phone close enough to a machine that permits "contactless" payments and your card
is set up to do that - that is, has the chip.

The OMNI reader doesn't know that I accidentally leaned too close to it so that my card ,even in my purse, was close enough to be read.  Of course the MTA (transit authority) is an approved collector of funds  The OMNI gadgets are collecting funds for the MTA.

I understand the how. It's the authorization I don't get. Somewhere along the line, the company has to ask to take the funds. Proximity isn't permission.

It is the placement of the machine on the bus that allows for contactless payment of bus fare that is the problem.. and it is likely to have swiped $2.75 from more people who wear their cards on a lanyard or have them in a pocket or purse that is at the same level as the fare taker on the bus. It doesn't affect people paying full fares that want to use any credit card to pay and so swish on purpose..  although there have been cases reported of someone being charged twice.. for those of us who have discounted metro cards the contactless payment on public transportation is not an option.. we still have to dip or swipe our senior or disabled citizen cards .  by 2025, we are told, all busses and train stations will be equipped with OMNI machines and using them will be the only option.. by then they are supposed to have figured out how to recognize that one is supposed to get a discount. BTW - the OMNI reads your phone if your phone has the correct stuff in it, or your apple watch, etc.

anyway, I"m getting an new little purse
