I base what I say mostly on literature about cell phone batteries. The average phone has a life of 2 years before the customer starts looking for a new one and laptop batteries seem to follow this trend. But I could be biased. Dell for several years shipped laptops with "Smart Fast Recharge" enabled in the BIOS. You get impressive recharge times, but this feature is known to shorten battery life considerably. Why does this happen? Is 3% too low to leave enough energy for > hibernating? Do you mean you configure the gadget to do one thing and the config is later rest to be something else? Or the gadget is configured to Hibernate but the laptop decided to Suspend instead? The former would need someone to look at the cadget code.
