and there's your "written documented proof" of prior art. it's another patent.
as such if you have an issue with this being patented at all then forget 8pen
the only valid patent that has a chance of standing up in a court is ken's
patent - so complain to him about his patent. forget 8pen. they will file
anyway and hope to get it even if a duplicate. when they go to investors for
money they can get more as they say "we have patented it". thats the value of a
patent to a small company. it means investor influx. for a large company it is
a stockpile of defense. (eg we have 500,000 patents. go on. try and sue us.
we'll strike back with our arsenal of 500,000 and i'm sure we'll find at least
some you infringe and then it's game on. since we have more than you... you're
the one who will lose). of course this strategy falls flat on its face when
attacked by a patent troll. they have no products to sue over. that's a major
flaw :)
