I assume that /etc/fbpanel/default is a conffile in the Debian package. If this is case, here we seem to have an obsolete conffile that is no longer used by the packaged program. I think that it should be removed from users' systems, but some users may have customized this system-wide configuration file, hence a strategy to preserve those local modifications should be implemented. I don't know which is the recommended practice in these cases: you probably know better. If I understand correctly what you are saying: when fbpanel configuration file does not explicitly specify an image to show as icon for a given application, then the icon provided by the application itself (if any) is shown. If everything else fails, then DefaultIcon = /usr/share/fbpanel/images/default.xpm is used. It seems to me that the behavior is still as outlined above. I tried the following: if I don't specify an icon for UXTerm, the DefaultIcon is shown. I am perfectly happy with this behavior: I just want to have some more images that may be used as explicitly specified icons!
