I don't really think it's a tangerine icon theme bug, the trash icons are provided in 16x16,22x22(24x24),32x32 and 48x48(scalable) sizes and as far as I know of the index.theme is correct, does switching to another icon theme (like gnome icon theme, tango icon theme or human) solve the issue?
