I think you're right that this problem affects the building of maybe any
module against a custom kernel, and isn't a problem with the fglrx
driver.

Also, you may be right about Ubuntu devs not caring about problems with
custom kernels. They should care, however. Eventually, lots of Ubuntu
users will want to recompile for features just not available in the
stock kernel, and making things like ATI or Nvidia drivers work with a
custom kernel is crucial to a satisfactory experience with the OS.
