I can confirm the bug's presence in Oneiric although it wasn't in Natty.
To reproduce
Open 'scale plugin' settings in CompizConfig Settings Manager, go to the
'bindings' tab.
Make sure that "Button Bindings toggle scale mode" is unchecked.
Assign a mouse button to initiate window picker
Open mul

Compiz Scale Plugin br
I'm sorry, I have to retract that. It happens when using a mouse button
and having "Button Bindings toggle Scale mode" disabled, no matter which
picker you use. All pickers work fine for key bindings, though it always
seems to toggle the window picker even if toggling for key bindings is
disabled.
It is reproducible by simply initiating the "Window Picker for Windows
on Current Output" in the Scale Plugin, either by mouse or by key. It
does only seem to affect the picker for the current output, though.
"Initiate Window Picker" and "Initiate Window picker for All Windows"
seem to work fine.
