I can confirm the bug's presence in Oneiric although it wasn't in Natty. To reproduce Open 'scale plugin' settings in CompizConfig Settings Manager, go to the 'bindings' tab. Make sure that "Button Bindings toggle scale mode" is unchecked. Assign a mouse button to initiate window picker Open multiple windows Press and hold the assigned mouse button to switch between windows.
Focus isn't properly given to the raised window. Global menus (including 'close', 'maximize' and 'minimize' buttons on maximized windows) cease to be available when you move the mouse cursor to the area at top of the screen.
