prudent to try and have the ISP's servers seized immediately both as
defense evidence and for use in a counter suit so that you and your
attorney can examine the evidence in time to prepare a defense before the
ISP has time to doctor the logs and security system.

As good as it would feel to have the ISP's servers confiscated, chances are
that it won't happen. I worked for an ISP that was cracked by the owner and
several employees of another ISP. There was sufficient evidence to warrant
a police raid on their office, but the police could not touch the servers
because they were public machines that contained the private information
(e-mail and such) of the ISP's clients. That part makes it much harder.
You may be able to make them turn over a copy of logs from that time period,
but I doubt you'll get the machine. Bummer! :)
