It's not distributed under the BSD license like you have indicated.
In fact, the author failed to include any license text with the source.

Please build it with the default CC and CFLAGS. The easiest thing is
probably to write your own do-build line, then you can skip patch-Makefile.
And use `make update-patches' to generate the patches.
