Hmmm. I'd say the whole thing was just sort of bungled from the PDML side. The photographer always retains all rights unless otherwise indicated. Anyone who has ever sold a photo or even displayed a photo must know that. It's as obvious as the nose on your face.
Just a wild guess, but anyone who reads the PDML would know this. It comes up in discussion several times a year.
