I think the failure is this line:
```
MergeThread newMergeThread = super.getMergeThread(mergeSource,
merge);
mergeThreadSet.add(newMergeThread);
```
`getMergeThread` now adds the merge thread set directly.

If we think this is an OK change, I am cool with it. However, I would much
rather keep the CMS completely untouched as its very brittle.
