Subject: Clarification Requested On Govt. "ORDER"

We  take the liberty of attaching  two attachments to this correspondence.

The first one  is the Newspaper cutting detailing  the enhanced salaries and
perquisits  of Ministers and MLAs of the government of Goa.

The second  is the "Order" issued by the Health Department, Government of
Goa regarding the settling of the arreas with respect to the retired  State
Nutrition Officer, Dr. N.S. Dumo.

The clarification sought from your good office is:

Whereas, the the lawmakers do not miss, in the slightest, the opportunities
to make laws to  enhancement their own  salaries and perquisites every now
and then, what is the criterion on which the below reproduced ORDER  of the
Cabinet, based, to arrive at the figure of Rs. 2 lakhs, payable to the above
named Government Officer who, because of the malafide inter-departmental
strife, has not been paid his well earned salary for the working lifetime of
past 29 long years? Pray, why such a large sum of Rs. 2 lakhs? Why not a
symbolic rupees 2 only,   in the name of your brand of "Good Governance?"
Or is your good  government just dishing out the well deserved "CHANDA"
that must be meekly accepted with a grateful " thank you?".

The Honourable Supreme Court has observed that the payment of salary to a
government employee is not a bounty which depends on the sweet will of the
government, but is the right earned by the employee through his/her services
to the state.

Your kind response shall be highly appreciated.

MINISTERS & MLAS TO GET HIGHER PAY
By: Herald Reporter.
Panjim- August 26- The  Goa Legislative Assembly on Monday passed an
amendement hiking the salaries and allowances of Ministers and MLAs, which
would cost the state exchequer a whopping Rs. 63 lakh annually.

The two amendment bills are:
The Goa Salaries and Allowances of Ministers (Amendment) Bill, 2002 and
The Goa Salaries and Allowances of Members of the Assembly (Amendment) Bill,
2002.

With the amendments passed, the consolidated pay packet of ministers has
increased by Rs. 6000- a Rs. 3000 hike in sumptous allowance and an increase
of Rs. 3000 in the compensatory allowance in liew of not availing govt.
accomodation.

The Legislature also hiked MLAs' salaries by Rs. 2000 per month.

Besides, several other facilities have also been extended to MLAs including
Rs. 3000 per month for rent to maintain offices in their constituencies , 3
personal staff - steno-typist, office boy & driver- payable at govt scale,
besides 200 ltrs of petrol per month

ORDER

Sanction of Government is herey conveyed for the grant of pay scale of Rs.
575-1150 (pre-revised) to Dr. N.S. Dumo, (Retired) State Nutrition Officer
under the Directorate of Health Services, w.e.f. 15/7/68 and fix his pay
accordingly in the said scale, with all consequential benefits subject to
the condition that the financial liability on account of past dues, if any,
shall not exceed a gross ceiling of Rs. 2 lakhs and the benefits  are
restricted to pensionery benefits payable.

The amount payable to Dr. N.S. Dumo (Retired) State Nutrition Officer under
the Directorate of Health Services, on this account shall be debitable to
the head of account to which his salaries were debited immediately, prior to
his retirement.

This issues with the approval of Cabinet in its meeting held on 8/1/2001 and
conveyed vide letter No.17/23/99/GAD(IV) dated 16/1/2001.
