Well as you've seen in the bug, it's all about legal considerations.

As I reported in it, the Certicom IETF contribution had been extended in 2008 to CMS (and SSH) which means ECC usage for CMS signing in Thunderbird is safe. However key generation might very well be another matter, especially since Certicom explicitly excludes CAs from the royalty free usage.

Brian reported there that this should be investigated by the legal group, but I'm worried nothing happened since then.
