Obviously. German copyright law was changed in the 1990ies to explicitly include even the most trivial programming work ("kleine Münze"). Eicar.com is undoubtedly programming work, and given it being short, a working DOS program _and_ printable at the same time I do not have any doubt that the program would pass as a "Schöpfung" in a court of law.
