I do not want EICAR to be copywritable, but I reckon it probably is. A surprising amount of work went into developing EICAR: it's a valid 16 bit DOS program as you point out, it's also composed entirely of printable characters and uses self-modification to ensure it does something useful when actually executed. As such it's clearly a creative work, and an original creation at that.
