I got the source for 2.9.9d+e-pre2-10 from snapshot.debian.net, compiled it, and it has the same problem. I tried reversing 10_drop_privileges.diff (2.9.9d+e-pre2-10 didn't use quilt, so I got the patch from 2.9.11~20080817-1; it reverses cleanly). With the patch reversed, the problem I'm seeing went away. The process being unkillable is rather worrisome to me, and makes me wonder if the privilege dropping is actually exposing a kernel bug. What kernel version are you using?
