there's no ssh involved in my scenario

i wonder if 1.7 has this same problem,
i'm using i guess a much older version of 1.5 or maybe even earlier on my
other computer and do not have the issue (that release contains rsync 2.x vs
the 3.x in this one causing issues)

So your using rsync in daemon mode then? As otherwise it will
default to using ssh unless you have a very old version using
rsh, so you may be using it without realising?
