Not correct. Uppercase tags are only illegal in XHTML, and there maybe only in 1.0.

Please Sir, what comes between HTML 4.01 and HTML5 that allows upper case tags?

It's part of the HTML5 spec:

"Attribute and element names of HTML elements in HTML documents must be treated as ASCII case-insensitive."

Or in more "layman's" terms:

  <http://webdesign.about.com/od/html5tags/f/are-html-5-tags-case-sensitive.htm>

"HTML 5, unlike XHTML, is not case-sensitive. This means that <HTML> and <html> and <HtMl> are all the same tag in HTML 5.
  Convention in HTML 5 is to Use Lowercase"
