I'll try and get the kernel team to examine the patch you've referenced.

I'm also just curious if this issue still manifests itself if you try to
upgrade from Hardy to the ucoming Intrepid.  But please note that
testing upgrading to Intrepid is completely at your own comfort level
though and not mandatory for you to do.  As noted in our Alpha release
announcements "Pre-releases of Intrepid are *not* encouraged for anyone
needing a stable system or anyone who is not comfortable running into
occasional, even frequent breakage.  They are, however, recommended for
Ubuntu developers and those who want to help in testing, reporting, and
fixing bugs."  I'm just curious if this will also affecct the upcoming
release.  Let us know if you feel comfortable to test and what the
results are if you do.  Thanks.
