Thanks for your bug report, and for finding the upstream bug report. Yes, as can be seen in the upstream fix (commit IDs below), this is a "typo" in the code that safely can be considered for a SRU (stable release update). The SRU rules dictate that this get fixed and tested in Intrepid first though.
