it could take quite a lot of developer time to find the change that fixed it, modifiy the change to work in an old kernel, test it and test that it does break other things. better use of their time is making a new driver work for the next ubuntu version. if there is anyone who can't upgrade to hardy they could request that it it gets fixed, but i imagine it would be low priority.
