Just update my Hardy and got the 2.6.24-18 kernel: it fixed the problem and even under heavy stress (transmission, azureus (java), evolution, firefox, amarok, synaptic) no shuttering occurs in _any circumstance_. I got the new kernel from the hardy-updates repository.
