I think I'm lowering the issue down.  If I use the onboard S3 graphic I
lose the problem.  So I purchased a new agp card assuming that was the
cause however the minute I plugged in the new agp card the Cd/Dvd-rw
issue returned.  I'm assuming therefore that is it something to do with
the via chipset on the motherboard.  To confirm this is the case I will
be installing gusty along side to see if it is the chipset as a whole or
a new kernel driver issue.
