This issue seems to be similar to Bug #1161599 as such is fixed in 13.10
however it seems it is only partially fixed.

Problem is when using deja-dup resp. duplicity to backup up a large
amount of files to Ubuntu One. After a couple of minutes the backup
aborts with "Giving up on request after 5 attempts, last status 400 Bad
Request". Before the bad request appears network usage indicates full
upload usage but after bad request appears nothing has been uploaded.
