With Ubuntu 13.04, this issue gained in severity. I could previously apply the patch mentioned in the first post to the appletouch driver and replace appletouch.ko with my custom version. However, the appletouch driver I have access to *without* fiddling with the entire kernel sources will no longer load in the Ubuntu 13.04 kernel.
