I've seen the issue appear again with 3.8.0-26.38 now as well, but it happens much less often. Commit 6a41b4d added a new codepath that returns -EXDEV (which is -18), which seems to get triggered sometimes... So I still consider this a kernel bug and we should let the guys at the lkml know.
