Restarted in 2.6.38-11 and was able to install the flgrx driver (NOT the 
post-release driver)
the post-release driver gave the same error.  when I was on the 3.0.0-12 kernel 
I was not able to install either driver.

Could jockey have a mismatch with the kernel version and the available
drivers?
