Ok, I can reliably reproduce this on my desktop:

- open gnome-terminal and move it close to the left border, verify that the 
launcher opens normally on top of it
- open firefox (old session with multiple windows), and see that the launcher 
still opens on top of the other windows
- click on the terminal to bring it up
- note that the launcher is now opened below the terminal/browser windows

for reasons yet unknown, I can't reproduce this on my laptop though.
