iFred, both issues are not covered by this patch. So the patched version should be released as official update to fix your original problem, especially the one of a wrong driver getting used.
Your new problems exist but are much less urgent. I know for sure that the second problem was handled upstream. For the first I do not know whether a simple patch exists upstream, as current upstream version (which is part of Natty) has substantial changes for the driver listing. Please report new bugs for both issues.
