They should first work to get the driver upstream, and this has nothing to do with Ubuntu itself.
What I saw is that there is a community effort to improve the quality of the driver, to then be able to push it at Linus' tree. At the moment this driver is located at the staging, and it's older than the vendor's one. The problem that happened at this bug is that the driver for 2.6.32 is broken, but fixed for 2.6.33. For Lucid, they decided to push 2.6.32 as default, without backporting the updates for this driver.
