After weeks of problems and the rfkill stopped working in kbuilds 16 and up. I then noticed that I have a button on the key board fro the wireless. As I tend not to use these as they are mostly for windoz boxes I did not have it physically turned on. Turned the switch on and up came my wireless system.
It seems that they fixed the software to recognize my hardware switch about kbuild 16. So what I had been looking a is a downward change in compatibility was in fact a upward change.
