I've been using this patch for 4 months now with no incident, and I've heard nothing on this from Ubuntu. In fact I still have to do it outside the package manager with each kernel release BECAUSE MAINTAINERS HAVEN'T incorporated the fix into the package. Its a fair bet they haven't up-streamed it either.
