Public bug reported:

Binary package hint: xorg-driver-fglrx

Alright first off theres an nvidia patch that works around this also.
The main parts of initerest are here are in the defines, if anyone wants to
make a cleaner patch, feel free to make a better patch.

As for fglrx there is a linux-rt-compat.patch , but the code it relates to
doesn't even exist.
I conjured up a small patch that works fine.
Attached to this post.

Some notes on the patch.
The added define may be useless I was adding it to help with patching something
else that in the end I just removed that section of the code.
I was doing this before I saw the nvidia patch as with the nvidia patch it
seems a function starting with atomic_spinlock would be the replacement.
Beside that I removed those lines of code because running through the header
files the regular spinlock in the realtime kernel seemed to do absolutely
nothing unless in debug mode.

This all aside the patch works and I'm using it right now without a
problem.

** Affects: fglrx-installer (Ubuntu)
     Importance: Undecided
         Status: New
