The first question above in my case is not applicable: my laptop was rock solid with Ubuntu 8.10 and is rock solid with development karmic. Cannot report about windows, and IMHO it shouldn' even be asked such a question. No settings have been modified/altered, and BIOS is vendor default. Attached my lspci output.
