I can also confirm this bug. Happened a few minutes ago - again(!). About the fourth time for me. Had about 15 GB worth of data in the trash. Now, the file system hasn't given me the space back and the trash is empty after forced reboot (held down power button).
How do I delete these files now?? Never happened on the same machine running 8.10 and EXT3. a tip for others: I have learned now to disconnect external hard drives and flash drives, closing all applications, and then I try to empty the trash bin... knowing the system will crash at least I prevented some loss of data.
