Let me tell you something interesting... Well, I can confirm I was also getting this bug on Ubuntu 8.04 and, surprisingly, today on Ubuntu 8.10... I did nothing to misconfigure my system actually. I just install NVidia driver myself using their .run packages from the official site. After installing their latest BETA 180.16 the gnome-panel trash applet stopped showing its actual status (when I delete smth. the icon remains empty, but if I click on it - the deleted stuff is there. Also, the 'Empty trash' link is active. I decided to uninstall nvidia driver back to previous BETA 180.11 and now it's ok with the trash applet. Strange? Yes.
