cleaned with cleaning disk - no change. data cable is fine. dma is ON in the BIOS, don't know why it would disable itself for the LIVE CD.
Anyway, I had to get going an installation so I tried the Alternate NON GUI install. worked perfectly. weird. So I guess I don't need anymore assistance.
