The bug is present in Ubuntu 12.10. It seems that the fix in libfox
1.6.37-1ubuntu2 was removed.
Please reintroduce it in libfox-1.6.45.

I can confirm the bug and it's 100% reproducible.
Here is a workaround: you can use devilspie (with its gui gdevilspie)
to setup a rule that unmaximizes each window when starting an
application. I tested it with a rule like this: unmaximize each window
whose class is not equal to 'dummy'. Using
