Ok "sudo update-grub" didn't work it didn't find the new kernel but I
did update to grub2 and it has found the new kernel and sound and mouse
has been fixed.

OK how do i get this sorted i only let ubuntu upgrade the only thing i
was asked what should grub do i left it to keep the same i dont want to
break anything

You're using the wrong kernel (2.6.28 is 9.04's).
