Repeated the test (see comment #6). Without the fix /upper is mounted
and then the kernel complains when we write a file to /upper. With the
fix, the kernel does not mount (as expected) and the kernel error

This bug is awaiting verification that the kernels for Oneiric
(3.0.0-28.45) and Precise (3.2.0-34.53) in -proposed solves the problem.
