Still works in 12.04, seems like making some sort of default limit would
be a good idea maybe?

into /etc/security/limits.conf as a default value to prevent this.

It seems that there is no limit for "max user processes" by default. So
Fork-Bombs [1] are still possible. They are used by M$-Junkies to show
that there are still problems with linux. Please fix it in
/etc/security/limits.conf by default.
