This issue appears to be an upstream bug, since you tested the latest
upstream kernel. Would it be possible for you to open an upstream bug
report[0]? That will allow the upstream Developers to examine the
issue, and may provide a quicker resolution to the bug.

Thanks Joseph. I tried the 3.9-rc3 kernel and can reproduce it (and
again the script suggested as a work around solves it). Furthermore the
lid switch doesn't suspend the laptop but that's a minor issue. I've
marked this confirmed and exists upstream.
