I have the same issue. ( tested also with 3.8.0 RC3)
But adding the kernel option 'i8042.noloop' will solve the problem.

I installed successfully:
linux-headers-3.8.0-030800rc1-generic_3.8.0-030800rc1.201212212135_amd64.deb
linux-image-3.8.0-030800rc1-generic_3.8.0-030800rc1.201212212135_amd64.deb
and booted successfully this mainline kernel v3.8, but it didn't fix the
problem.

Would it be possible for you to test the latest upstream kernel? Refer
to https://wiki.ubuntu.com/KernelMainlineBuilds . Please test the latest
v3.8 kernel[0] (Not a kernel in the daily directory) and install both
the linux-image and linux-image-extra .deb packages.
