I tried option 4. The patch went cleanly, everything compiled okay and from
the testing I did it is working just fine. Thanks. It plays nicely with
wireshark
too.

Yes my remote system shares the same kernel as the other customers.
Calling it a 32 bit guest isn't accurate. Sorry about that. Subject title
changed.
The kernel I've been told is Red Hat derived,

I have a problem capturing in a 32 bit guest on a 64 bit VZ/OpenVZ host.
It worked in a 64 bit guest but I had to change to 32 (another story.)
The software can tell the captured data is there but chokes or aborts on
it. Here are a couple of pings then a fatal web request.
